Medical Considerations
I understand that Phoenicia Travel staff are not medical professionals and are unable to accept any responsibility regarding medical advice, medications, or inoculations that I or my doctor deem necessary for my safe participation. I am aware that Phoenicia Travel assumes no liability regarding the provision of medical care while on the tour or any medical expenses incurred during the trip.
Travel Insurance
Travel insurance policies generally provide coverage against personal accidents, medical expenses, emergency repatriation, personal liability, cancellation, curtailment, and loss of luggage and personal effects. I understand that it is up to me to decide if I wish to pay for travel insurance and to choose an insurance provider. Phoenicia Travel highly recommends travel cancellation and health insurance for all tour participants.
Participant Responsibilities
By participating in a Phoenicia Travel tour program, I am aware that I assume certain obligations to Phoenicia Travel and the other tour members. It is my responsibility to:
• Understand the conditions as set forth in the Phoenicia Travel itinerary and trip suitability descriptions.
• Recognize my own personal limitations and be aware that touring involves standing, walking, climbing stairs, sitting for long periods during bus and airline travel, and other physical activities that I may not be used to. Sites may have uneven walking surfaces and stairs and often temperatures are higher than I may be used to.
• Select a tour (with the help of the Phoenicia Travel staff) that is appropriate to my interests and abilities and prepare myself for the tour by reviewing the itinerary and tour packet sent by Phoenicia Travel.
• Be responsible (including any additional costs) for supervising and transporting my own luggage during check-in, between flights, when taking ground transportation or checking into hotels, when porter services are not included in tour fees, or I bring more than the allowed number of bags.
• Bring appropriate gear and clothing as advised by Phoenicia Travel.
• Follow considerate standards of personal hygiene in order to reduce the risk of contracting diseases.
• Follow considerate social behavior with other group members and appropriate to the customs of countries visited.
• Complete the tour itinerary as scheduled (or as adjusted by my tour leader as necessary).
Travel within a group may involve compromise to accommodate the diverse desires and physical abilities of group members. The tour leader will do his/her utmost to ensure that any problems are solved for the benefit of the group as a whole. Travel, hotel, and tour services at the international level vary widely and may not conform to U.S. ADA policies. We regret that we may not be able to provide extra assistance to tour participants who have special mobility, dietary or other limitations while traveling with Phoenicia Travel outside the U.S.
Any portion of the travel program that a person is unable or chooses not to participate in is non-refundable. Signing this Informed Knowledge and Form signifies my acceptance of the leader's authority to make decisions affecting the group or individuals. For example, he/she may recommend an individual not participate in a particular activity that puts a person's health or safety at risk and may not be able to provide an alternate activity. Should the leader take such action, that person would not be entitled to any refund.
Changes in Itinerary and Accommodations
I acknowledge that travel on a Phoenicia Travel tour requires a degree of flexibility, and understand that the airline flight changes, changes in route, accommodation, and modes of transport are all subject to change without prior notice due to local circumstances. Phoenicia Travel reserves the right to make reasonable changes in the itinerary where deemed advisable for the comfort and well-being of tour members. These changes are binding, and additional expenses will be charged to you if the reason for any alteration is outside the control of Phoenicia Travel.
Third-Party Contracts and Services
I acknowledge that Phoenicia Travel contracts with a network of companies, government agencies, and individuals to assist in the running of its tours. To the best of Phoenicia Travel’s knowledge, these third parties are qualified to perform the duties they are contracted to perform. However, Phoenicia Travel will not be held liable for any injury, damage, loss, delay, or irregularity that may occur due to the behavior of these third parties. Any air travel that is part of any tour is subject to the conditions as stipulated by the airline concerned and liability is limited in accordance with International Convention. No employee, servant, or agent of Phoenicia Travel has the authority to vary these conditions.
Participants Under 18 Years of Age
Participants under 18 years of age must be accompanied by a parent or legal guardian, who is responsible for the supervision, and in the event of an accident or illness, is able to legally authorize medical treatment. I am aware that traveling with someone under 18 years of age may require that I provide additional legal documents in order to meet border and customs regulations for travel between countries and to obtain medical treatment.
Dispute Resolution and Jurisdiction
If a dispute arises, I agree to first try and resolve it directly with Phoenicia Travel. If the dispute remains unresolved, I agree to go to mediation and will accept the solution provided by the mediator. If a mediator is not agreed upon or appointed, I and Phoenicia Travel agree to participate in an arbitration as outlined by the American Arbitration Associate.
The terms of this agreement shall serve as a release and assumption of risk binding on my heirs, executor, administrator, and all members of my family.
Acknowledgment of Risk and Release from Liability
I understand that, although Phoenicia Travel will take steps to foster safety, there are inherent risks in many activities, and there are significant levels of personal responsibility that I must assume for myself. I understand that I am traveling to geographical areas where, amongst other things, the standard of accommodation, transport, safety, hygiene, cleanliness, medical facilities, telecommunications, and infrastructure development may not be of the standard I am used to at home or would find on a conventional holiday. I have read and understood the itinerary and suitability description for this tour and have provided details of any pre-existing medical conditions that may affect my ability to fully participate in all tour activities.
I accept these risks and obligations and fully assume the risks of travel. I release Phoenicia Travel from any liabilities arising from my participation in the travel program including the risks of travel to the maximum extent permitted by law.
I understand that this is a release of liability and a contract between me and Phoenicia Travel and/or its contracted tour operators or affiliated organizations, and I sign this agreement of my own free will. If any part of this agreement is deemed unenforceable, all other parts shall remain in full force and effect.
